Once an investigation has been completed and the offender is arrested, they are presumed innocent until convicted by a court of competent jurisdiction. If the offender has been charged with the violation of a misdemeanor crime, they will normally fall under the jurisdiction of the City of Madison Municipal Court.
In some instances, the offender may me charged through the Madison County District Court. All offenders arrested on felony charges fall under the jurisdiction of either the Madison County District / Circuit Court or the Limestone County District / Circuit Court.
The jurisdiction on felony cases is determined by the location where the crime was committed. Once the offender has been charged, it is up to the court to keep the victim, investigators, and officers apprised as to the status of a case. This is done through the subpoena process. If a victim, investigator, or witness is needed for a court appearance, they will be notified by the court.
