About Us

The Madison Municipal Court is a trial court of limited jurisdiction over criminal prosecutions. Although considered to be a part of the Unified Judicial System of Alabama, the municipal court is funded entirely by the municipality. The municipal court exercises jurisdiction over violations of municipal ordinances occurring within the city limits and shares jurisdiction with district court for misdemeanor violations of state law upon adoption by the municipal governing body. Functions include management of all pending cases filed with the court; maintenance of all court records; collection and remittance of all fines, forfeitures, court costs, and restitution; issuance of subpoenas, summons, warrants, and certified copies of court records; and provision of criminal complaint services to the public.

You may settle any of the following traffic offenses without making a court appearance, provided:

1. You wish to plead guilty to the charge.
2. You pay the ticket in full prior to your court date.

Payment may be made with cash, money order, debit card, or credit card.
NO PERSONAL CHECKS WILL BE ACCEPTED.


To pay the ticket in person, you may come by the court office at 100 Hughes Road between the hours of 8:00 a.m. and 5:00 p.m., Monday - Friday.

If you have received a ticket for any offense other than those listed above,
YOU MUST APPEAR IN COURT ON THE DATE/TIME SHOWN ON YOUR TICKET. DEFENSIVE DRIVING SCHOOL The Level I Defensive Driving Course offered by Madison Municipal Court is a court referral program for traffic offenders. This 4-hour class covers the three contributors to accidents and violations: the driver, the vehicle, and the environment.

General Questions

WHO MAY ATTEND? A licensed driver charged with a minor, moving traffic offense may attend the Level I class provided that he or she has not attended any other defensive driving class within the preceding two years and does not hold a commercial drivers license.

HOW MUCH DOES IT COST? Minimum Fee is $154 for the Level I class. The amount must be paid in full prior to the class date.

HOW DO I SIGN UP FOR THE SCHOOL? Registration forms or further information may be obtained from the Court Clerk's office prior to your scheduled court date.

CAN I CHANGE MY CLASS DATE ONCE IT IS SCHEDULED? No. Class dates cannot be rescheduled. If you fail to appear for your class, you have forfeited the opportunity to attend class and must appear before the judge on a given court date.

Q: What is the court schedule?
A: Court is held on Wednesday and Friday at 8:30 a.m. You will need to appear on the date given by the officer. If you are unable to determine your court date call 772-5617
Q: What can I do if I need more time to pay my fine?
A: If you need additional time to pay your fine, you must appear in court and the judge/magistrate will determine if an extension is granted
Q: Can someone else come and pay a ticket for me?
A: No. You must appear in person to enter a guilty plea and sign a Waiver of Rights Form.
Q: How can I protest my ticket?
A: You must appear in court before a judge to protest your ticket.
Q: Can I change my court date?
A: Court dates are changed only in the event of a verifiable emergency. Inability to pay fines is not considered an emergency. Once you have appeared before a judge, only the judge can change your court date.
Q: What will happen if I do not show up for my court date?
A: A warrant will be issued for your arrest and, in some cases; your drivers license will be suspended.
 
Q: Can I talk to the judge or prosecutor?
A: The judge will only talk to you about a court matter in court. The prosecutor's office can be contacted at (256) 772-5681.
Q: What do I do if I have an outstanding warrant against me?
A: You must turn yourself in to the Madison Police Department. You will be able to post bond (except in Violation of Probation cases) as soon as the Police Department concludes the booking process. Bond may be posted in cash or through a Professional Bonding Company.
Q: How do I obtain a warrant?
A: After you have filed a police report, contact the Court Clerk's Office to make an appointment. After conducting a hearing, a Magistrate will determine if there is probable cause to issue an arrest warrant. Filing a police report does not insure that a warrant will be issued.
Q: Can I drop a warrant?
A: Once a warrant has been issued, all parties involved must appear in court.
