Did you know the construction zone laws have changed in Alabama? A person cited for a violation will now require a mandatory court appearance and if found guilty or pleading guilty, a minimum of a $250 fine and court costs, totaling $416. This is an increase from tickets prior to July 1st averaging $200 without a required court appearance.
Within the City of Madison limits, there have been an increase of construction zone violations along Sullivan Street construction. Residents can expect increased patrol in the area as extra safety precautions.
As of July 1, 2021; Act 2021-482 “Construction Zone Moving Violation” went into effect. This act amends 32-5A-176.1 Ala Code 1975 “Speeding in a construction zone” and replaces it with “construction zone moving violation”. The act provides enhanced punishment for violating a chapter 5 or chapter 5A title 32 traffic offence when ALL of the following conditions are met:
1. the person is in a construction zone designated by the Department of Transportation or a political subdivision of the state;
2. construction or maintenance workers are present and performing construction or maintenance work; and
3. there are work zone traffic control devices, traffic controls, or warning signs present to notify motorists and pedestrians of construction or maintenance workers present in the area.
